Asian Games gold medallist Pinki Pramanik was granted bail after 25 days by a West Bengal court on Tuesday on the ground that as neither male nor female organ was found during the medical tests, the athlete cannot rape.Pramanik was arrested on June 14 after she was accused of being a male by her 30-year-old live-in partner, who also alleged she was raped. “The district and sessions judge (North 24-Parganas) while granting bail to Pinki, based on her medical reports, has held that neither male nor female organ was found in her body. That means she is physically incapable of committing rape,” Pinki’s counsel Tuhin Roy said.Pinki was granted bail on a personal bond of Rs 5,000. “The women who had alleged that Pramanik had raped her, was in a live-in relationship with the athlete for nearly three years. It means the relationship was consensual by nature,” Roy said. Roy said that Pinki’s chromosome test report (karyotyping) determining her gender identity was not submitted before the court by the SSKM Hospital on Tuesday.
